Justice Ronald Tindale clarified: "It was the defendant’s Casino Account and it was the defendant’s money which was used to play the winning game all without the permission of the defendant." He emphasized that the winnings were not mistakenly paid to the defendant.

Jones claimed the win was the result of his 'strategy'. But Justice Tindale disagreed, stating that a game of chance requires no strategy that leads to a win, apart from the mere act of playing itself. The judge accepted Johnson's argument that she had explicitly forbidden Jones from using her account. The winning sum was obtained on a slot machine at JackpotCity. Although JackpotCity is not licensed in British Columbia, this fact did not influence the ruling. Instead, PlayNow is the only government-authorized online casino in the province. Jones had also admitted that Johnson's then 16-year-old son also made a few spins, although this was prior to the actual jackpot win. In British Columbia, all gambling is prohibited for minors under 19.

Justice Tindale found that primarily Jones was gambling and the son was merely passively present, which did not entitle Jones to the winnings.

Another interesting aspect was Jones's Facebook post after the win. He wrote "he won" instead of "I won." According to Jones, this was referring to himself, but Justice Tindale found this explanation implausible.
